Separate Ownership to Protect Your Share

- Tenants in Common: Your share becomes part of your estate, allowing it to be distributed through your Will. This can be used to leave your share to someone other than the joint owner or to protect your assets post-death via a Trust.
Severance of Tenancy is one of the most important — and most overlooked — estate planning steps for any couple jointly owning property in Bristol. The vast majority of homes in Bristol, Clifton, Redland, Henleaze and the surrounding areas are held as Joint Tenants by default, which means that on first death the entire property passes automatically to the surviving owner, completely outside the will.
Converting your ownership to Tenants in Common splits the property into defined shares (typically 50/50, but it can be any split). Each share then forms part of that person's estate and can be left through their will — usually into a Property Protection Trust. This is the single most effective way for Bristol homeowners to protect half the value of the family home from being assessed for care home fees, and to ring-fence each partner's share for their own children (essential for blended families).

If the Land Registry search reveals you're already Tenants in Common, we refund your payment less the £20 + VAT search fee.
